1. GENERAL TERMS AND CONDITIONS OF SALE

Purpose 
These General Conditions of Sale concern the purchase of products and services, carried out remotely via telephone and paper-format communications (e.g. postcards)  and via electronic network on the website www.shoped.it and on all the websites connected to it (Quattroruote, Ruoteclassiche, Tuttotrasporti, Domus, Meridiani, Cucchiaio d’Argento, Dueruote, X Off Road), part of the “Ed Network” owned by Editoriale Domus S.p.A. with registered office in Rozzano (near Milan) at via Gianni Mazzocchi 1/3, and through Editoriale Domus App stores available on Play Store.
Such purchases are open exclusively to direct user Customers, with the express exclusion of parties such as merchants, wholesalers, retailers, professionals, etc., intending to resell the products to third parties. All purchases shall be subject to the provisions of Paragraph I of Chapter III of Part III of Legislative Decree no. 206 of 6 September 2005 (Consumer Code), and, as far as the protection of personal data is concerned, to the provisions of Legislative Decree no. 196 of 30 June 2003.

Types of products on sale 
The products sold by Editoriale Domus are of three types: print editorial products, subscriptions to print magazines published by Editoriale Domus for which the subscription purchase formula is provided, and digital products.

Acceptance of the General Conditions of Sale 
By confirming his/her purchase order, the Customer unconditionally accepts and undertakes to comply, in his/her relations with Editoriale Domus S.p.A., with these General Conditions of Sale and the methods of payment, and declares that he/she has examined and accepts all the instructions provided, pursuant to the above-mentioned laws, and in addition acknowledges that Editoriale Domus S.p.A. shall not be bound by different conditions, if not previously agreed in writing.

Obligations of the Customer 
These General Conditions of Sale must be examined and accepted by the Customer before he or she confirms the purchases. It follows that the confirmation of the order by the Customer implies that the Customer him/herself has understood and accepted such conditions in their entirety.
Once the purchase procedure is completed, the Customer undertakes to print out and retain these General Conditions of Sale, already examined and accepted during the purchase procedure carried out.

Applicable Law and Place of Jurisdiction 
These General Conditions of Sale are subject to the Italian Law. Any disputes arising with regard to the validity, interpretation or execution of this contract shall be governed by the local Courts of the place where the Customer is resident or domiciled, provided it lies within the territory of the State.

2. METHODS OF PURCHASE

The purchase of the products, as displayed and described in the material made available to the Customer, is made by the Customer at the price indicated therein, including the P&P costs and the costs related to the payment method. Before completing the purchase, the unit cost for each product selected, the total cost in case of purchase of several products as well as the total P&P and payment costs shall be displayed for the Customer.
After the purchase, if a valid email address in provided, the Customer will receive an email message with the number, the date anche the total amount of his/her order.

3. METHODS OF PAYMENT

The following methods of payment are available for purchases of print editorial products, digital editorial products, other digital products, made from Italy or from abroad:

The user may cancel standing order payments at any time by contacting the company PayPal directly. PayPal is the sole party responsible for any inefficiencies relating to the payment instrument. For further information, please refer to:

4. PRODUCT DELIVERY 

Delivery of physical products such as books, binders or folders
Products are delivered within one week of the order, with the exception of certain specific conditions such as works that are pre-ordered, which will therefore by delivered starting from the date notified by Editoriale Domus for the delivery.
The products purchased shall be delivered to the address specified by the Customer. Shipping charges are according to delivery and destination. Deliveries are made on working days (from Monday to Friday). Said deliveries may also be made with separate deliveries without any responsibility being incurred by Editoriale Domus.
For the delivery of its products, Editoriale Domus uses the services provided by courier firms.
The Customer must check the products upon receipt and the consistency of the products delivered with the order made, and more specifically that:
• the number of parcels indicated in the waybill corresponds to the number of parcels actually delivered;
• the parcel has not been tampered with, and is not damaged or wet.
The Customer should sign the delivery note only after checking the above. If the delivery note has been signed, the Customer shall have no right to make any claims with regard to the exterior appearance of the items received. In cases where the items delivered are not consistent with the order made, the Customer must not accept them and must make a claim directly to the courier.

Editoriale Domus shall under no circumstances be liable for any delays in the delivery of products due to the actions or faults of a third party, which are beyond its control.

Delivery of copies of the print magazines included in the subscription
For subscriptions to monthly magazines, the first copy will be delivered within 5 weeks of the order. For subscriptions to two-monthly magazines, the first copy will be delivered within 10 weeks of the order.
The magazines included in the subscription shall be delivered to the address specifies by the Customer. Shipping charges are according to delivery and destination. Deliveries are made through the postal service. In case the magazine is damaged or is not delivered, the Customer may request a replacement copy from the Subscriptions Service. Editoriale Domus shall under no circumstances be liable for any delays in the delivery of products due to the actions or faults of a third party, which are beyond its control.
For subscriptions to print magazines, where specified, consultation of the digital edition is included. The consultation of the digital edition included in the subscription has the same start date and duration as the print magazine subscription taken out. Instructions to access the digital edition are sent to the Customer by an email if a valid email address is provided by the Customer.

Delivery of subscriptions and digital copies
Activation of the digital subscription and consultation of the digital copy takes place immediately after payment of the order, the moment from which the service/product is considered to be delivered.

5. WITHDRAWAL AND INTERRUPTIONS

Pursuant to and within the limits of the above-mentioned Consumer Code, the Customer has the right, within 14 (fourteen) days of receipt of the goods ordered, to exercise the right of withdrawal.
Said right applies to all the products with the explicit exclusion of digital products, software products, audio-visual products or IT software delivered sealed and subsequently opened by the Customer, and of newspapers, periodicals or magazines with the exception of subscription contracts for the supply of said publications.

How to exercise the Right of Withdrawal for print products
To exercise the right of withdrawal, the Customer must send a notice of withdrawal, also by using the form available through the link below, within 14 (fourteen) days from receipt of the goods. The notice must be signed by the Customer and sent by registered mail, by the deadline. It may also be sent by telegram, fax or email, by the same deadline, on condition that it is confirmed by registered mail with return receipt within 48 hours. It should be addressed to:

Within 14 (fourteen) days of the receipt of the notice of withdrawal, Editoriale Domus shall communicate to the Customer via email to the email address given by the Customer him/herself, the ‘Lettera di Vettura’ (waybill) so that it can be attached to the goods to facilitate their return.
The Customer must return the goods within 14 (fourteen) days from the date on which the waybill is received. Editoriale Domus will then send an order for the cost of the goods to be re-credited, together with the cost of the first shipment, within 14 (fourteen) days after the goods are received from the Customer. The reimbursement will be made via the same means of payment used by the Customer for the initial transaction, unless the Customer paid cash on delivery, in which case the refund will be credited to the current account indicated by the Customer.
The Customer must return the goods in the condition in which they were delivered, with packaging intact.
The costs relating to the return of the goods by the Customer to the sender are charged to the Customer.
Editoriale Domus shall in any case refuse to accept any products for which the shipment costs were not paid by the Customer in full, were sent without complying with the methods and expiry dates set out in the Consumer Code with regard to communications relating to withdrawal rights, or in case the product was returned without the original packaging, without all the accessories, instruction manuals and anything else included in the original delivery.

Withdrawal from subscriptions to print magazines
The Customer may terminate a print magazine subscription within 14 (fourteen) days from the date on which the first issue is received, by sending a notification of withdrawal, also by using the form available through the link below. The notice of termination must be signed by the Customer and sent by registered mail, by the deadline. It may also be sent, by the same deadline, by telegram, fax or email, provided that it is confirmed by registered mail with return receipt within 48 hours. It should be addressed to:

The first issue must be returned to Editoriale Domus at the above address within 14 (fourteen) days from the date on which the notification of withdrawal was sent.
The Customer must return the copy of the subscription in the condition it was delivered in, with packaging intact. The cost of returning the goods to the sender shall be paid by the Customer. Editoriale Domus shall reject any item for which the costs of return shipment have not already been paid in full by the Customer, or if the terms and conditions stipulated above with regard to notification of withdrawal have not been complied with, or if the product is not adequately packaged or is incomplete.

Interruptions and suspensions by Editoriale Domus
Editoriale Domus may interrupt and suspend the Service at its sole discretion, and shall reimburse the Customer with the amount of the subscription payment that was not used as a result of the interruption and/or suspension.

Early termination of subscriptions to print magazines
The Customer may terminate a print subscription that has already been paid for even before its expiry. In this case, the Customer shall be reimbursed only for those copies not yet delivered included in the subscription. The Customer can contact the Subscribers Service.  Exceptions to right of withdrawal and early termination for digital products
The Customer explicitly accepts that, pursuant to article 59, paragraph 1, letter (o) of the Consumer Code, once the supply of the digital content has begun, exercise of the right of withdrawal is excluded.
In this respect, it is hereby stated that neither early termination nor the right of withdrawal apply to digital subscriptions.

6. PRICES AND TAXES

All the prices of Editoriale Domus’s products include VAT, and therefore all purchase transactions also include VAT. For physical print products, VAT is applied at the rate of 4% (VAT paid by publisher), for digital products VAT is applied at 4% (VAT shown), for all other digital products VAT is applied at the rate of 22% (VAT shown).

APPLE APPLICATIONS 

Purchase on Editoriale Domus Apps available on Apple’s AppStore
Purchases made from the Editoriale Domus App on Apple’s AppStore are made using the iTunes payment system managed entirely by the company Apple. It follows that the terms and conditions of sale shall be governed by Apple. In some cases, the subscriptions proposed activate a standing payment order and at the end of the period selected (e.g. 1 month) the Customer is automatically charged the same amount and can use the service for a similar subscription period. The user can disable the standing payment order at any time (up to 24 hours before the expiry of the subscription) directly from his/her iTunes profile. Apple is the sole party responsible for any inefficiencies relating to the AppStore and to the relative payment instrument (e.g. where the user cannot cancel the standing payment order).

7. SECURITY

The ShopED website (and related websites including the shop in the Editoriale Domus app on Play Store) is a service offered in collaboration with Stripe and Pay Pal.
Service offered in collaboration with Stripe. During the purchase process, addresses belonging to stripe.com website may appear. All communications between the browser of the Customer and the servers are encrypted using the SSL (Secure Socket Layer) protocol. The encryption renders all the data (in particular credit card numbers) illegible during the purchase process, to guarantee secure, confidential transactions. On completion of the purchase the Customer  will receive an e-mail, confirming his/her transaction.

8. COPYRIGHT

For its products, Editoriale Domus S.p.A. possesses all exclusive rights of economic exploitation related to the work as a whole and to all the texts and images that form part of it. The reproduction of the work or parts of it for all purposes other than mere private use is forbidden. No part of the work may be reproduced or transmitted in any form or by any means, electronic, mechanical, photographic or otherwise, without the prior written consent of the copyright owner. Under these Conditions of Sale, any form of exploitation of any part of the products bought by the Customer and/or of their contents for economic gain, including by way of example the archiving or storing of the Content to allow access by third parties, creating summaries, extracts or other works derived from the Content, eliminating the copyright or trademark from the products and/or from their contents is prohibited. The Customer may only use the products sold by Editoriale Domus S.p.A. for personal use. Editoriale Domus disclaims all liability for any form of direct or indirect loss connected to use of the products.
